1. Our Commitment to Copyright

To be effective, your notice must be a written communication sent to our Designated Copyright Agent (contact details below) and must include substantially the following 6 points:

  1. Your Signature: A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
  2. The Copyrighted Work: A clear identification of the copyrighted work you claim has been infringed. (e.g., a link to your original article, a description of your book, etc.).
  3. The Infringing Material: A clear identification of the material on our site that you claim is infringing. You must provide the specific URL(s) of the page(s) on Fiknow.com where the material is located.
  4. Your Contact Information: Your full legal name, mailing address, telephone number, and email address.
  5. A “Good Faith” Statement: A statement from you that you have a “good faith belief” that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. An “Accuracy” Statement: A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner.

3. Our Designated Copyright Agent

All DMCA Takedown Notices must be sent to our official Designated Copyright Agent. Sending your complaint to any other email or person may delay our response.

4. What We Do After Receiving a Notice

Once we receive a complete and valid DMCA notice:

  1. We will promptly investigate the claim.
  2. We will remove or disable access to the content that is claimed to be infringing.
  3. We may, at our discretion, attempt to contact the person who posted the content to inform them of the removal.

5. Counter-Notification Procedure

If you believe that your content was removed by mistake or misidentification (for example, you believe you have “fair use” rights), you may send us a “Counter-Notice.”

To be effective, your Counter-Notice must be a written communication sent to our Designated Copyright Agent and must include substantially the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the URL where it appeared before it was removed.
  3. Your contact information (name, address, telephone number, and email).
  4. A statement, under penalty of perjury, that you have a good faith belief that the material was removed as a result of a mistake or misidentification.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside the United States, for any judicial district in which Fiknow.com may be found), and that you will accept service of process from the person who provided the original DMCA notification.

6. Repeat Infringers

Fiknow.com has a policy of terminating, in appropriate circumstances, the accounts of users (if any) who are determined to be “repeat infringers” of copyright.

7. Disclaimer

Please be aware that if you knowingly and materially misrepresent that material or activity is infringing (or that it was removed by mistake), you may be held liable for damages (including costs and attorneys’ fees) under Section 512(f) of the DMCA.
